LOST PACKAGES
RUM Rituals Beauty is not responsible for lost or stolen packages after confirmed delivery.
A tracking number will be sent to your email as soon as your order has been processed and tracking information becomes available. Once you have received your shipping confirmation and the package has been transferred to the shipping carrier, the carrier will have the most current information regarding the status and location of your package.
If your items are being shipped to a business address, please include the name of the business as well as the name of the recipient at the business in your order.
It is the responsibility of the customer to provide accurate and complete shipping address and contact information.
RUM Rituals Beauty will not be responsible for orders that have been confirmed as delivered by the applicable shipping carrier, except as otherwise required by applicable law.

ARBITRATION

The arbitration shall take place at a location mutually agreed upon by the parties or through another method permitted by the applicable arbitration rules.
The arbitrator’s award shall be final and binding, subject to any rights of review or relief available under applicable law, and judgment on the award may be entered in any court having jurisdiction.
In the event that any legal or equitable action, proceeding, or arbitration arises out of or concerns these Terms and Conditions, the prevailing party may be entitled to recover costs and reasonable attorneys’ fees to the extent permitted by applicable law and the applicable arbitration rules.
The parties agree to arbitrate disputes and claims arising out of or relating to these Terms and Conditions, whether directly or indirectly, including applicable tort claims arising from these Terms and Conditions.
The Federal Arbitration Act shall govern the interpretation and enforcement of this arbitration provision to the extent applicable.
Questions concerning the scope or enforceability of this arbitration provision shall be determined in accordance with applicable law and the applicable arbitration rules.
This arbitration provision shall survive termination of these Terms and Conditions.
CLASS ACTION WAIVER
To the extent permitted by applicable law, any arbitration under these Terms and Conditions will take place on an individual basis. Class arbitrations and class, collective, or representative actions are not permitted.
THE PARTIES AGREE THAT EACH PARTY MAY BRING CLAIMS AGAINST THE OTHER ONLY IN THAT PARTY’S INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PUTATIVE CLASS, COLLECTIVE, OR REPRESENTATIVE PROCEEDING.
Unless both you and RUM Rituals Beauty agree otherwise, and except as otherwise required by applicable law or arbitration rules, the arbitrator may not consolidate more than one person’s claims or otherwise preside over any form of representative or class proceeding.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, RUM RITUALS BEAUTY AND/OR ITS SUPPLIERS DISCLAIM IMPLIED WARRANTIES OR CONDITIONS OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, RUM RITUALS BEAUTY AND/OR ITS SUPPLIERS SHALL NOT BE LIABLE FOR INDIRECT, PUNITIVE, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES, INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS OF USE, DATA, OR PROFITS, ARISING OUT OF OR IN ANY WAY CONNECTED WITH THE USE OR PERFORMANCE OF THE SITE; any delay or inability to use the Site or related services; the provision of or failure to provide services; or information, software, products, services, and related graphics obtained through the Site, whether based on contract, tort, negligence, strict liability, or otherwise, even if RUM Rituals Beauty or its suppliers have been advised of the possibility of such damages.

TERMINATION AND ACCESS RESTRICTION
RUM Rituals Beauty reserves the right, in its sole discretion and subject to applicable law, to terminate or restrict your access to the Site and related services, or any portion thereof, where appropriate.
To the maximum extent permitted by applicable law, these Terms are governed by the laws of the State of Illinois and applicable federal law, without regard to conflict-of-law principles.
To the extent that a dispute is not subject to the Arbitration provision above, you consent to the jurisdiction and venue of courts located in Illinois, subject to applicable law.
Use of the Site is unauthorized in any jurisdiction that does not give effect to applicable provisions of these Terms.
You agree that no joint venture, partnership, employment, or agency relationship exists between you and RUM Rituals Beauty solely as a result of these Terms or your use of the Site.
RUM Rituals Beauty’s performance of these Terms is subject to existing laws and legal process, and nothing contained in these Terms prevents RUM Rituals Beauty from complying with governmental, court, regulatory, or law-enforcement requests or requirements relating to your use of the Site or information provided to or lawfully gathered by RUM Rituals Beauty.
If any part of these Terms is determined to be invalid or unenforceable pursuant to applicable law, including, but not limited to, warranty disclaimers and liability limitations, the invalid or unenforceable provision will be interpreted or modified to the extent permitted by law to most closely reflect its original intent. If such modification is not possible, the provision will be severed, and the remainder of these Terms will continue in full force and effect.
